1. I think I have a legal case or problem and what should I do?
This is the most consistently asked question after more than 28 years of practicing law (in good standing, I should add). As an experienced law practitioner in private law practice in civil, criminal, and appellate law, and formerly in government with the Hawaii State Attorney General’s office, I will give you a prompt and honest answer. 2. Do I have to file a lawsuit? Most lawsuits should be filed within two years of the harm to yourself or your loved ones. A lawsuit is not necessary if whoever harmed you will try to resolve the problem honestly and fairly. Unfortunately, the primary reason for my filing of a lawsuit is because wrongdoers can be unreasonable, unfair or very dishonest! Thus, access to the courts by the filing of a lawsuit for a fair remedy must be done. However, I do try to attempt an out-of-court settlement first. As you may already know, filing a lawsuit and the ensuing litigation can be very expensive to the average family.
3. How much are your services going to cost me? If you have a worthy case and you call early, a “contingency fee” attorney’s contract could be the best way to proceed. I will advance the legal costs and if we win, I will ask you for reimbursement of the costs that I advance plus 1/3 of any recovery. Other cases can be done on a flat fee basis or hourly basis. In order to promote justice and equal access to the courts, I have taken quiet pride in myself to offer working families access to the courts when other attorneys have rejected their case or the financial arrangements are simply too high. 4. Can you guarantee me a successful result? In my opinion, no worthy attorney will ever issue a guaranteed result.
